As a brief overview, most charges begin with an accusation by a victim, witness, or law enforcement officer. A complaint is made which will result in a sworn complaint or and arrest. Once either is completed the next stage will be a formal charge, known as an information which is filed by the state attorney’s office (for misdemeanors or traffic infractions there are some exceptions). After an information is filed you will be summoned for an arraignment, which is a formal reading of the charges. Typically, a plea of not guilty is entered, and the case will either be placed on a management docket of some kind. Discovery – which includes police reports, written statements, videos, etc. will be provided to your attorney in this time period. With the aid of your counsel, you will have to make decisions on whether you can negotiate an agreeable resolution or if you proceed to trial.
