What Happens After Arrest?

Arrested in Gainesville or Alachua County? Here Is What Usually Happens Next.

For many people, an arrest is confusing and overwhelming. Understanding the process can help reduce uncertainty and prevent costly mistakes.

At Landsman Law, we guide clients through every stage of the Florida criminal process.

Step 1: Booking Into Jail

After an arrest, a person is typically transported to the local County Jail for booking.

This process generally includes:

  • Fingerprinting
  • Mugshots
  • Property inventory
  • Entry into the jail system

Step 2: First Appearance

Florida law generally requires first appearance within 24 hours of arrest.

The judge may:

  • Determine probable cause
  • Set bond
  • Impose release conditions
  • Appoint counsel in some cases

Step 3: Formal Charges

The State Attorney’s Office reviews the case and decides whether to formally file charges.

Sometimes:

  • Charges are reduced
  • Charges are declined
  • Additional investigation occurs
  • Diversion options become available

Step 4: Arraignment

At arraignment, the accused typically enters a plea:

  • Guilty
  • No contest
  • Not guilty

In many cases, a written plea of not guilty may avoid the need for a personal appearance.

Step 5: Discovery and Investigation

This phase may involve:

  • Police reports
  • Body camera footage
  • Witness statements
  • Forensic evidence
  • Motion practice

A defense attorney may identify constitutional or evidentiary issues that affect the case.

Step 6: Negotiation, Motions, or Trial

Some cases resolve through:

  • Diversion programs
  • Plea negotiations
  • Reduction of charges

Other cases proceed to:

  • Suppression hearings
  • Evidentiary motions
  • Jury trial

Do Not Assume the State’s Version of Events Is Correct

Arrests are based on allegations — not convictions. Early legal representation can make a significant difference in protecting your rights and future.

Matt represented me and I was never disappointed. His tenacity and experience are impeccable. He maintains a positive vibe which always helped me keep the faith. He does know the law and is respected in the courtroom. In the end he won my case and every single dime spent was well worth it. He literally helped me believe in myself again.

I had a criminal and civil matter. Mr Landsman handled the criminal matter. Even though he did not usually handle the particular civil area, he made an exception in order to help me. However, I decided I would go with a former judge thinking he was more qualified. Huge mistake. I regret not staying with Mr. Landsman. He was confident, competent and very gracious when I reconnected with him and told him I had made a huge mistake by hiring another attorney. I regret not having stayed with Mr. Landsman after dealing with two other attorneys.
